AC Outage & Temporary Displacement Credit Policy (Tenant & Staff Guide)

When a tenant experiences a loss of AC service, our process is guided by Arizona landlord-tenant requirements, which require the landlord to make necessary repairs within a reasonable amount of time. Once the issue is reported, our maintenance team prioritizes AC repairs immediately due to health and safety considerations in Arizona’s climate.

1. Repair Responsibility & Timeline

The landlord is legally required to repair AC issues within a reasonable timeframe.
In practice, AC issues are treated as urgent and are dispatched immediately.
If the system is restored within a short timeframe (typically within 24 hours), the landlord has met the legal obligation.

2. Alternative Housing (Hotel / Airbnb / Staying Elsewhere)

Landlords in Arizona are not required to pay for hotel, Airbnb, or alternative lodging during AC outages.
Tenants are free to choose where they stay if they decide to leave the home temporarily.
If a tenant cannot stay at the home and stays with family or friends, they will be credited rent divided by 30 (daily rent value) for the verified impacted days.
Any lodging costs beyond the approved credit amount are the tenant’s responsibility.

3. How the Temporary Housing Credit Works

Arizona law provides a structured method for calculating a daily inconvenience credit when a tenant is impacted.
This is based on a standardized formula:
Monthly rent ÷ 30 = daily rent value
This results in a per-day credit based on the verified loss of AC and habitability impact.

4. When the Credit Applies

The credit begins after 24 hours of verified AC outage.
If the AC is repaired within that timeframe, the credit is limited accordingly (often one day or less).
If the home has more than 1 AC unit and at least one unit is working and providing cooling, no credit will be provided, as the home remains habitable.
If the outage lasts longer, the credit increases proportionally per day until service is restored.

5. Key Principles for Staff Application

Always verify repair timeline (when reported vs. when restored).
Confirm whether outage exceeded 24 hours.
Confirm whether the home remained habitable (including functioning secondary AC units).
Apply credit only for verified impacted days.
Do not promise hotel reimbursement beyond per diem credit unless explicitly approved.
Document all communications and receipts if submitted.

6. Important Context for Tenants

While temporary discomfort is understood, the credit is designed as a standardized and legally aligned method of compensation for loss of AC-related habitability. It is not intended to reimburse full lodging costs but to provide a consistent daily credit when applicable.
